This privacy statement specifically concerns Faresa's digital tools such as the Totem app, Burn-OutAid (BOA) app, the Faresa Digital Tools (FDT) app, and e-learning modules (ELF).

Faresa BV places great importance on the protection of personal data. Scope

This privacy statement applies to all digital products offered by Faresa, such as the Totem app, Burn-OutAid (BOA) app, the Faresa Digital Tools (FDT) app, and e-learning modules (ELF).

What personal data does Faresa collect with these tools

The following personal data provide a general overview of the type of data that Faresa collects and processes with digital tools to provide its products and services:

  • Personal data: name, email address, phone number, and other contact details, socio-demographic factors such as age, gender, nationality, partner relationship, family composition, level of education, profession, work, and date of birth, and general information about your relationship with your employer;
  • Health data: information about your well-being, physical and mental health, risk situations and risk behaviors, and other health-related or contextual data;
  • Usage data: during your use of Faresa's e-mental health applications, servers hosted by third parties for Faresa store information about your usage and the device you use to access Faresa's products and services, based on your IP address(es) or in any other way (automatically or not).
  • Specific apps (e.g., Totem app) may collect additional data. For details, see below.

Personal and sensitive data of app users 

For the Totem app, it utilizes your location, even when the app is running in the background only. The Totem app also has access to movement data from your phone and activity tracker, provided you have given permission for this in the app. This is crucial for our psychologists to closely monitor your therapy in detail. These data remain strictly confidential and are never shared with third parties.

Data processing 

Faresa processes your personal data on one of the following legal grounds, depending on the purposes:

  • Faresa processes your data for the performance of a contract in which the data subject is a party or to take steps at the request of the data subject prior to entering into a contract.
  • Faresa processes your data to comply with a legal obligation to which the data controller is subject.
  • Faresa processes your data to protect the vital interests of the data subject or of another natural person.
  • Faresa BV processes your data for the performance of a task carried out in the public interest or in the exercise of official authority vested in Faresa.
  • Faresa processes your information for the legitimate interests pursued by Faresa or by a third party, except where such interests or fundamental rights and freedoms of the data subject (you) requiring protection of personal data override those interests, particularly where the data subject is a child.

If no other legal basis applies, Faresa processes your data after you have given consent to the processing of your personal data for the purposes described in this document and/or the privacy statement or informed consent of the provided service or product.

As a data subject, you may refuse or refrain from providing personal data, or in certain cases, you may be required to provide the personal data. Refusing or refraining from providing the required personal data may have certain consequences for the performance or provision of services or products provided by Faresa, where the collection of personal data is a legal or contractual requirement, or a requirement necessary to enter into a contract.

Purpose: for what purpose does Faresa collect and process your personal data?

Your personal data is processed in order to provide the following products and services:

  • Providing e-mental health applications
  • Conducting well-being surveys
  • Providing adequate assistance
  • Offering an Employee Assistance Program

In certain cases, your personal data may be used in an automated decision-making or profiling process.

In certain cases, your personal data may be used for a purpose other than that for which your personal data was collected. In that case, Faresa will provide you with information prior to such further processing.

Faresa will embed data protection "by design & by default" or in the early stages of development of services and products in an obvious manner, as required by GDPR legislation. The necessary privacy measures will be built into the default settings of the tools in a user-friendly manner.

 

Data retention

Your personal data will be stored from the moment it is received and for a period of up to 30 years to enable us to efficiently contact you and ensure the continuity of our services. 

To protect the personal data under our control, we apply a policy, rules, and security techniques entirely in accordance with the applicable legislation regarding the protection of privacy in the jurisdiction of the products and services. The security measures are intended to prevent any unauthorized access, improper use, or disclosure, unauthorized alteration, and unlawful destruction or any accidental loss.

 

Your rights

If you believe that your personal data is incorrect or incomplete, or if you wish to obtain clarification about whether or not your personal data is being processed, you have the right of access (see: right of access), the right to rectification (see: right to rectification), and the right to erasure (see: destruction of a file).
